1.Definition

CityQuester is a type of a game, which combines a fun of treasure / scavenger hunt with a sightseeing walk of the city (hereafter “Quest game”).
Guided from the smartphone, players make their way through the city, following the route from one point to another, searching for answers, performing different tasks and solving clues.

The following terms and conditions apply to the booking, payment and execution of Quest games for groups and individuals, hereinafter referred to as “the Customer” organized by CityQuester, hereinafter referred to as “the Organizer”.

Communication between Organizer and the Customer during the Quest game is done by the 3rd party instant messaging solution (like Telegram, FB Messenger, Whatsapp etc), hetreinafter referred to as “the Messenger”.

2.Contractual Partners

The Customer concludes a contract with the Organizer.

3.Applicability

The terms and conditions are the basis and part of every contractual agreement between the Organizer and the Customer.

The terms and conditions of the Customer do not apply, even if the Organizer does not contradict their validity separately.

4.General

For reasons of legibility it has been avoided to consistently use female and male forms throughout theses terms and conditions.

Type and scope of the contractual services result from the description in the order confirmation.

Upon request the Customer will be lent a SIM card or smartphone for the duration of the Quest-game. Customer undertakes to use this SIM-card and smartphone only for the purpose of the Quest-game and to return it to the Organizer in undamaged condition at the end of the Quest-game.

In case of any misuse of the SIM card, the Organizer reserves the right to take legal action.

5.Conclusion of a contract

The booking and the booking confirmation occurs electronically.

The contract is considered as successfully concluded once the booking confirmation indicating date of the Quest-game has been dispatched and the payment request has been transmitted to the Customer.

Booking can be made by phone call or via the website (https://www.cityquester.com).

The booking consists of the following steps:

  1. The Customer fills out the booking form on the website https://www.cityquester.com/
  2. The Organizer contacts the customer via e-mail and:
    • a.Confirms date and time of the Quest-game and transmits a payment request or
    • b.Offers up to 5 dates and times to choose from
  3. In the case of 2b, the customer must choose one of the suggested options and communicate his choice to the organizer. This is followed by the step 2a.

6.Payment

Upon booking an Quest-game, the Customer receives confirmation of his booking and an invoice.

The Customer can make the payment either via the website https://www.cityquester.com via the payment link sent in email with booking confirmation or by bank transfer. In the case of bank transfer, the invoice contains the account data and the purpose.

Only after the receipt of payment the Customer has a right to participate in the booked Quest-game.

7.Change of a date/time of the Quest-game

Once a date and time of the Quest-game has been confirmed it can be changed once if requested by the customer. A change can be made free of charge up to 7 days prior to the Quest-game.

8.Execution of the Quest-game

After the date and time confirmation and the payment the Organizer sends the organizational details (what to prepare, meeting point, etc.) to the Customer.

A representative of the Organizer should wait for the Customer at the agreed meeting point. The meeting point will be communicated to the Customer in the booking confirmation.

The Customer needs to have a fully loaded smartphone with a functioning Messenger installed on it.

The Quest-game begins by sending the codeword  The codeword communicated to the Customer via Messenger at the meeting point.

Furthermore, the Customer will be informed of the telephone number, through which an operator can be reached. An operator is available to the Customer by phone during the Quest and helps him or her to orientate himself or answer questions if any arise.

At the end of the Quest-game, a representative of the Organizer will be waiting at the same meeting point as at the beginning of the game.

9.Cancelation of the Quest-game

If the Customer wishes to withdraw from a booked event without claiming an alternative date, cancellation fees will be charged due to effort incurred, namely:

  • 50% of the invoiced amount if canceled up to 3 days before the booked date
  • 100% of the invoiced amount if canceled 24 hours before the Quest-game.

In case of any earlier cancellation and without accepting an alternative date, the Organizer will reimburse the full amount of the bill.

Any difference will be refunded to the customer’s account. Cancellations can be made by phone, e-mail, WhatsApp or SMS. Cancellation is deemed to be received by the date on which the organizer has confirmed receipt of the cancellation to the Customer.

10.Rebooking or cancellation by the Organizer

If an event is canceled by the Organizer, the Organizer will reimburse the full amount of the bill, unless Organizer and the customer agree on an alternative date. This regulation does not apply in case of force majeure.

11.Bad weather conditions

If the event has to be canceled due to bad weather conditions, and because it cannot be carried out without risks for the participants, the Organizer undertakes to propose the Customer two alternative dates.

If the Customer cannot accept any of the two proposed dates, the Organizer refunds the amount paid once the Customer disclosed the bank details.

12.Applicable law and Jurisdiction

Except otherwise stipulated in these terms and conditions or agreed in writing between the Customer and the Organizer, the contractual relationship between the Customer and the Organizer is subject exclusively to Czech law.

The exclusive place of jurisdiction for all legal disputes arising out of or in connection with this contractual relationship is Prague. Mandatory legal requirements regarding sole places of jurisdiction are unaffected by this provision.

13.Knowledge and Acceptance of the T&Cs

The Customer accepts these conditions for himself and all participants with submitting the booking form.

14.Privacy

Required data traffic is handled considering the applicable data protection regulations.

The collected, processed and stored data will only be used for the purpose of processing the contract and operating the Quest-game. Unless there is a legal or regulatory obligation to do so, no data will be disclosed to third parties.

15.Copyright

The recording and/or copying of parts or the whole Quest-game is forbidden. In case of violations the Organizer reserves the right to take legal steps.

16.Liability and Obligation to Cooperate

By accepting these terms and conditions the Customer is pointed out with caution that participation in the Quest-game is at Customer’s own risk. The Organizer doesn’t take upon any liability for potential damage of persons or things.

The Customer is obliged to participate in the fulfillment of the agreed contract and to avoid any damages or faults.

The Quest-game can take place on public roads and paths as well as on paved and unpaved roads. The Customer must judge for himself and on his own responsibility and decide whether they meet these requirements.

Misjudgments in this context are the sole responsibility of the Customer. The Customer is liable for any damage caused by or to the items carried by him.

Should children and youth groups participate in the Quest-game, the Organizer does not assume the duty of supervision.

It is expressly stated that entering buildings or enclosed land is at your own risk.

17.Severability clause

The invalidity of individual passages of these terms does not result in the ineffectiveness of the whole. The invalid or ineffective provisions are substituted by the relevant statutory provisions.
